Employment Tribunal fees: Judicial review by UNISON

In February 2014 UNISON unsuccessfully brought judicial review proceedings to challenge the introduction of employment tribunal fees. UNISON’s challenge failed because the High Court considered it too soon to assess the impact of fees. UNISON appealed against the High Court’s decision and it was agreed that the best way forward would be for UNISON to bring fresh judicial review proceedings, relying on claims statistics produced over the last 12 months. Fresh judicial review proceedings were heard at the High Court on 21 and 22 October 2014. The court reserved judgment and a decision will be expected before Christmas.
