Trade unions are increasingly relying on Section 145B of the Trade Union Labour Relations (Consolidation) Act 1992 (TULRCA) in negotiations with employers over changes to collectively agreed terms and conditions of employment. With a number of recent Tribunal cases colleges need to be aware of the issues involved and how to respond.
This case law review explores the recent Tribunal cases and gives guidance on how best for colleges to avoid any potential claims under section 145B TULCRA.
